Amendment to the New Overtime Wage Act

On June 30, 2021, we notified the community that the NEW Virginia Overtime Wage Act was effective beginning July 1, 2021.  Since then, an amendment (budget bill, HB 7001) was passed and signed by the governor on August 10, 2021. The amendment allows non-exempt employees to have the option again to receive overtime leave in lieu of overtime wages.

 

What action is required as a non-exempt employee?

  • If you wish to resume receiving overtime leave in lieu of overtime wages, complete the Overtime Leave Employee Agreement Form and send the completed form to payroll@gmu.edu. If you do resume receiving overtime leave, please know that you will not be able to change your election until August 2022.
  • There is no action required for law enforcement officers who were not impacted by the NEW Overtime Wage Act because of the exception under Va. Code 9.1-701.
  • Budget bill, HB 7001 is not retroactive for the period of July 1 - August 9.  Overtime leave should not be awarded in lieu of overtime wages for this period.
